The ousted Governor Murtala Nyako of Adamawa state has petitioned National Judicial Council (NJC) over the role played by the incumbent Chief Judge of Adamawa, Justice Ishaya K Banu, and former Acting Chief Judge of the state, Justice Ambrose Mammadi, in denying him justice over his impeachment.
Nyako was impeached out of office last year by the Adamawa State House of Assembly on alleged 21count charges of gross financial misconduct.
“From August 2014 when the case was assigned to him to date, no substantial progress was made. He has used every ploy to delay the case to the extent of even deliberately refusing to return to Yola from Abuja on a date he fixed for hearing even when our legal team endeavoured to be in Yola from Abuja and Lagos. “He also gives long adjournments and refuses to attend court on days he fixes for hearing. He creates unnecessary bottlenecks in the case hindering the delivery of justice,” Nyako alleged.
He similarly accused Banu of trying to interfere in another case involving him by applying to be joined as interested party when he had no legal interest to protect in the matter. “As a judicial officer in whose court ,a case is pending, what does his involvement connote other than bias and a desire to ensure that justice is delayed which is justice denied. “How could a judicial officer be so biased as to abuse his privileged position and protection under the law to be joined in a suit involving a private citizen demanding for justice in an action designed to challenge his right to fair hearing,” Nyako queried.
