The Federal High Court, Abuja on Wednesday struck out a suit filed by late Prof. Sule Bello and maintained by Comrade Abdulmajid Daudu and a host of others.
The afore-mentioned persons instituted the suit at the Federal High Court, Abuja last year challenging the national chairmanship of Mallam Falalu Bello, OFR as they claimed to have passed a vote of no confidence on his leadership.
Justice Mobolaji Olajuwon ruled that their so-called suit is lacking in merit hence interpreted their purported vote of no confidence as illegal.
While ruling, the judge struck out the name of PRP from the suit on the grounds that the party filed in its preliminary objection that for PRP to sue in its name, the NEC must approve the suit and since the recognized NEC which the deponent is acting for didn’t authorize the suit the action cannot be maintained in the name of the party.
On the issue of removal of 1st Respondent, Mallam Falalu Bello, both the two constitutions exhibited differently by the plaintiff and defendant said the National Chairman could only be removed by 2/3 majority and Mallam Falalu Bello deposed to affidavit that about 1000 plus delegates voted for him, so he can’t therefore be removed from office by 100 plus party members.
