The Magistrate Court 1 sitting in Abuja has struck out all counts of criminal conspiracy and ownership of an unlawful society brought against the Director of Radio Biafra and leader of the indigenous People of Biafra (IPOB), Mr. Nnamdi Kanu, by the Federal High Court.
The Chief Magistrate Shauibu Usman, in a ruling yesterday discharged and acquitted Kanu of all criminal charges brought against him by the Department of Security Service (DSS).
Usman’s ruling is inline with the request by the DSS to drop the charges against the Biafran activist in order to enable them pursue his trial at the higher court for terrorism.
The DSS had argued that the Magistrate Court lacked the jurisdiction, since they have obtained the Federal High Court (FHC) order to detain him for 90 days based on terrorism charges.
Kanu is standing trial on Criminal conspiracy, managing and belonging to an unlawful society and criminal intimidation contrary to Section 97, 97B and 397 of the penal code.
The fact of the case, according to DSS report was that the accused formed an unlawful society with the purpose of bringing into being a Republic of Biafra. – Thisday.
