The Federal High Court sitting in Enugu on Thursday reserved judgement for Sept. 30 in a case of fundamental rights abuse filed by one Mrs Obianuju Okoronkwo.
Okoronkwo filed the case after the operatives of the Economic and Financial Crimes Commission (EFCC) allegedly raided her residence on June 10, 2012 and whisked her and her three children away.
Okoronkwo, who is the wife of former boxer Ikechukwu Okoronkwo, alleged that the operatives detained her and her children till 9 p.m. on the said date before releasing them.
She is also claiming the sum of N40 million as compensation for the alleged arrest and detention.
In his counter-affidavit, the counsel to the EFCC, Mr Kenechukwu Chukwuma-Eneh, denied the arrest of the applicant, saying she was only invited to the office to explain how she got a medical report on behalf of her husband.
Chukwuma-Eneh said it was Mrs Okoronkwo who insisted on taking her children to the EFCC office and that she was released as soon as she made her statement around noon.
At the conclusion of hearing on Thursday following the adoption of all the processes, Okoronkwo’s counsel, Mr Nnaemeka Okeke, urged the court to grant the prayers of his client in their entirety.
He said that his second further and better affidavit and other processes were enough to discountenance any objection.
Adopting his own processes, Chukwuma-Eneh urged the court to dismiss the application for wasting the time of all the parties and asked it to award N100,000 costs against the applicant.
Justice Dorothy Agishi reserved ruling after adopting the processes.
